PREAMBLE
These"General Conditions of Sale"apply to legal transactions relating to products marketed to its customers by Julie & James sarl within its virtual store.
DEFINITIONS:
The words or expressions below will have the following meaning in the context of these presents:
Internet store:refers to the Julie & James sarl website on which the Products are presented and sold to customers.
Order:refers to the sales contract concluded between Julie & James sarl and the customer of Julie & James sarl's Internet store.
Product sheet:refers to the classified information concerning a product provided by Julie & James sarl when the said product is put on sale in its internet store.
Products:refers to all the goods and services offered for sale by Julie & James sarl in its internet store.
Service:refers to the sale of Products by Julie & James sarl to customers of its Internet Store.
Transaction:refers to all operations, secure processing, authorizations and agreements inherent in the payment of the price of Products ordered by credit card.
ARTICLE 1:OBJECT
The purpose of these General Conditions of Sale is to define the terms and conditions under which Julie & James sarl offers and sells its Products to its customers.
These general conditions of sale will prevail over all other conditions appearing in any other document, except prior exemption, express and written.
ARTICLE 2 - ACCEPTANCE OF CONDITIONS
The customer acknowledges having read, at the time of placing the Order, these general conditions of sale and expressly declares to accept them without reservation.
These general conditions of sale govern the contractual relationship between Julie & James sarl and its client, both parties accepting them without reservation.
ARTICLE 3 - PRODUCTS
The majority of products offered by Julie & James sarl to its customers are immediately available.
However, all the products marketed by Julie & James sarl may or may not necessarily be sold online.
ARTICLE 4 - ORDER
The automatic registration systems are considered as proof of the nature, content and date of the Order.
Julie & James sarl will confirm to the customer the acceptance of his Order by sending a confirmation message to the email address that the latter will have communicated. The sale will not be concluded until the sending of the said order confirmation.
Julie & James sarl reserves the right to refuse or cancel any Order from a customer, in particular in the event of the insolvency of said customer or in the event of a default in payment of the Order concerned or of a previous delivery or a dispute relating to the payment of a previous order.
The mentions indicated by the customer, when entering the information inherent to his Order, binds him. Julie & James sarl cannot be held responsible for errors made by the customer in the wording of the contact details of the recipient of the Order (delivery address, billing address in particular) and delivery delays or the inability to deliver the Products ordered. that these errors could cause.
ARTICLE 5 - PRICE
The price is expressed in euros.
The price indicated on the Product Sheets does not include the costs inherent in transport.
The price indicated in the Order confirmation is the final price expressed inclusive of all taxes and including VAT. This price includes the price of the Products, the handling, packaging and storage costs of the Products, the transport and commissioning costs.
ARTICLE 6 - PAYMENT
The price invoiced to the customer is the price indicated on the Order confirmation sent by Julie & James sarl.
The price of the Products is payable in cash by one of the means of payment offered on the site on the day of the actual order.
The Order validated by the customer will only be considered effective when the secure bank payment center has given its agreement on the transaction and, where applicable, after acceptance of the assumption of the risk by the insurer.
ARTICLE 7 - APPLICABLE LAW
These general conditions of sale are subject to French law.
ARTICLE 8 - RESPONSIBILITY
Julie & James sarl cannot be held responsible for any damage of any kind, whether material, immaterial or bodily, which could result from a malfunction or from the misuse of the products sold.
The responsibility of Julie & James sarl will, in any event, be limited to the amount of the order. In the event of difficulties in the application of this contract, the customer and Julie & James sarl reserve the right, before any legal action, to seek an amicable solution.
Otherwise, for professional customers, the Commercial Commercial Court at the company's headquarters has sole jurisdiction, regardless of the place of delivery and the accepted method of payment.
